New Jersey Labor Law Poster Requirements
Every business owner in New Jersey should be aware of the specific requirements set forth for Labor Law posters. Labor Law posters display laws put into place to protect both the business as well as the employees of a business. It is essential that these documents stay current and are displayed where all employees are able to view them.
Labor Law posters that are required for New Jersey businesses include the Federal Minimum Wage poster, OSHA, FMLA, USERRA, EEO, Schedule of Hours for Minors, Conscientious Employee Protection Act (whistleblower) and Child Labor Law Abstract. By law, the Labor Law posters must be displayed where employees have access to them; most businesses display them in places like the break room, supervisors’ office or a back room where employees have access to. Although New Jersey is not required to have Labor Law posters displayed in different languages it is to the benefit of the business that if more than 5% of employees speak a foreign language, like Spanish, then the Labor Law posters be displayed in the specific language of those employees. This can reduce any discrepancies that may occur from employees who are unable to accurately understand the Labor Law posters which are not in their native language. Once again, this is not a requirement in New Jersey, but the business owner should make their best judgment call when deciding whether to display bilingual Labor Law posters.
It is required by law for all New Jersey businesses who employ at least one employee, to display the required Labor Law posters. It is essential that the posters are current and updated frequently, as the laws can change without notice. If caught without the appropriate Labor Law posters, or if they are out of date, the business owner can be cited and/or fined. Therefore it is in the best interest of the business owner to comply with the requirements put in place in regards to the Labor Law posters.
